What information do we collect?

 

We collect information from you when you visit or register on the Site, place an order, enter a contest or sweepstakes, respond to a survey or communication such as e-mail, or participate in another Site feature. When ordering or registering, we may ask you for your name, e-mail address, mailing address, phone number, credit card information or other information. We also collect information about gift recipients so that we can fulfill the gift purchase.  The information we collect about gift recipients is not used for marketing purposes.

What do we do with your information?

When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address.

Email marketing (if applicable): With your permission, we may send you emails about our store, new products and other updates.

Text marketing (if applicable): With your permission and/or registration for the Program (as defined in Section 9 below), we may send text messages about our store, new products, and other updates. Updates include checkout reminders.  Webhooks will be used to trigger the checkout reminders messaging system.

We may collect your information from third parties that work with us in connection with the Services or with the functioning of the Site and features thereof.

How do we protect visitor information? 

We implement a variety of security measures to maintain the safety of your personal information. Do we disclose the information we collect to outside parties? 

We do not sell, trade, or otherwise transfer to outside parties your personally identifiable data/information unless we provide you with advance notice, except as described below.  The term “outside parties” does not include Back to the Roots.  It also does not include website hosting partners and other parties who assist us in operating our Site, conducting our business, or servicing you, so long as those parties agree to keep this information confidential.  We may also release your information when we believe release is appropriate to comply with the law, enforce our Site policies, or protect our or others’ rights, property, or safety.  However, non-personally identifiable visitor data/information may be provided to third parties for marketing, advertising, or other uses.  

We and our vendors may collect information about usage of the Site via advertising identifiers to support or deliver personalized advertising and other business analytics.  An advertising identifier is a randomly generated alphanumeric code associated with a user’s device.  Advertising identifiers provide us a way to identify a user’s device without using a permanent device identifier, such as serial number.  

The California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 (collectively, the “CCPA”) defines the terms “sell” and “sale” broadly to include the sharing of personal information with third parties for something of value, even if no money is exchanged. How can you opt-out, remove or modify information you have provided to us? 

To modify your e-mail subscriptions, please let us know by modifying your preferences in the “My Account” section. Please note, that due to email production schedules, you may receive emails already in production. 

To delete all of your online account information from our database, sign into the “My Account” section of our site and remove your shipping addresses, billing addresses & payment information.  Please note that we may maintain information about an individual sales transaction in order to service that transaction and for record keeping.

You may exercise certain rights regarding your personal information you have provided to us.  In particular, to the extent permitted by applicable law, you have:

  • The right to request that we confirm whether or not we are processing your personal information. You also have the right to access such personal information.

  • The right to request that we correct any inaccurate personal information we maintain about you.

To exercise the opt-out rights described above, you need to submit your request to us by contacting us via the contact details provided in this Policy. For us to respond to your request, we must know who you are.  We cannot effectively respond to any request if we are unable to verify your identity and therefore confirm the personal information in our possession that relates to you. You are not required to create an account with us to submit any such request. We will use any personal information collected from you in connection with the verification of your request solely for verification and shall not further disclose the personal information, retain it longer than necessary for purposes of verification, or use it for unrelated purposes. If you want to submit requests to opt out of sale or sharing and targeted advertising activities via a user-enabled global privacy control, such as for example the Global Privacy Control (“GPC”), you are free to do so and we will abide by such request in a frictionless manner.

As permitted by law or to provide our Services, we are not required to delete data or information we use to:

Should we need more time, we will explain to you the reasons why, and how much more time we may reasonably need.  Should we deny your request, we will explain to you the reasons behind our denial (where envisaged by applicable law you may then contact the relevant authority to submit a complaint). Please note your personal data may be used for legal purposes by us in legal proceedings or in the stages leading to possible legal action arising from your improper use of this Site or the Services. You acknowledge and agree that we may be required to reveal personal data upon request of public authorities.

We do not charge a fee to process or respond to your request unless such request is manifestly unfounded or excessive and in all other cases where it is permitted by applicable law.  In such cases, we may charge a reasonable fee or refuse to act on the request.  In either case, we will communicate our choices and explain the reasons behind them.

SMS/MMS Mobile Messaging Marketing Program

We respect your privacy. We will only use information you provide through the Program to transmit your mobile messages and respond to you, if necessary. This includes, but is not limited to, sharing information with platform providers, phone companies, and other vendors who assist us in the delivery of mobile messages.  WE DO NOT SELL, RENT, LOAN, TRADE, LEASE, OR OTHERWISE TRANSFER FOR PROFIT ANY PHONE NUMBERS OR CUSTOMER INFORMATION COLLECTED THROUGH THE PROGRAM TO ANY THIRD PARTY. Nonetheless, We reserve the right at all times to disclose any information as necessary to satisfy any law, regulation or governmental request, to avoid liability, or to protect Our rights or property. When you complete forms online or otherwise provide Us information in connection with the Program, you agree to provide accurate, complete, and true information. You agree not to use a false or misleading name or a name that you are not authorized to use. If, in Our sole discretion, We believe that any such information is untrue, inaccurate, or incomplete, or you have opted into the Program for an ulterior purpose, We may refuse you access to the Program and pursue any appropriate legal remedies.

We may process your “Personal Data,” which means any information relating to an identified or identifiable natural person, including an identifier such as your name, an identification number, location data, an online identifier or other factors specific to your identity.

You directly provide us with most of the Personal Data we collect. We collect and process Personal Data when you:

  • Register online or place an order for any of our products or services.

  • Voluntarily complete a customer survey or provide feedback on any of our message boards or via email.
